  4. These Terms and Conditions are made available free of charge at fawk.pl/regulamin, in a manner that allows them to be accessed, viewed and saved, including in PDF format.
  5. A ‘User’ is any person using the Website.

§ 2. Scope and nature of the Website

  1. The Website is intended for informational and promotional purposes. It serves to provide information about the Foundation’s activities, its patron, the Wierusz-Kowalski family, and about events and publications.
  2. Use of the Website is free of charge and does not require registration.
  3. The Foundation does not conduct any sales via the Website.
  4. The Website provides a contact form intended solely for sending enquiries to the Foundation.

§ 3. Technical requirements and risks

  1. To use the Website, you simply need a device with internet access and a web browser supporting HTML5 and CSS3 standards, with JavaScript and cookies enabled.
  2. To send a message via the contact form, you must have a valid email address.
  3. The Foundation endeavours to ensure the continuous operation of the Website; however, technical interruptions, including those resulting from failures on the part of the hosting provider, are possible.
  4. The use of services provided electronically involves the typical risks associated with the internet, in particular the possibility of receiving malware or messages impersonating the Foundation. The Foundation never asks for passwords or payment details in its messages.

§ 4. Rules for using the Website

  1. The User undertakes to use the Website in accordance with the law, accepted standards of behaviour and these Terms and Conditions.
  2. In particular, the following is prohibited:
    a) sending, via the contact form, content that is unlawful, offensive, vulgar or infringes the personal rights of third parties;
    b) sending unsolicited commercial communications;
    c) taking actions that disrupt the operation of the Website, including attempts to gain unauthorised access, automatically downloading content on a scale that overloads the server, or circumventing the form’s security measures;
    d) providing the personal data of third parties via the form without a legal basis.
  3. In the event of a breach of the above rules, the Foundation may restrict the User’s access to the contact form.

§ 5. Contact form

  1. To send a message, you must provide your first name, surname, email address and the content of the message, and accept these terms and conditions. Providing a telephone number is optional.
  2. Messages are accepted solely for the purpose of providing a reply. The rules governing data processing are set out in the privacy policy.
  3. The Foundation endeavours to reply to messages without undue delay; however, it does not guarantee a specific timeframe or that a reply will be provided at all.
  4. The number of messages sent from a single IP address within a short period of time is limited — this is to prevent the form from being flooded by automated messages.
  5. The contract for the provision of the contact form service is concluded upon sending the message and expires upon a reply being provided or upon the expiry of the message retention period specified in the privacy policy. The user may cease using the Website at any time without making any further declarations.

§ 6. Copyright

  1. Texts, studies and photographs produced by the Foundation or on its behalf (including those from events), archival materials and the layout of the Website are protected by copyright and are the property of the Foundation or are used by it on the basis of separate licences.
  2. The works of Alfred Wierusz-Kowalski are in the public domain. Reproductions of these works published on the Website may be used freely; the Foundation requests that the source be cited (the collection from which the work originates, or the Website). The Foundation may make higher-resolution files available upon request, subject to agreed terms.
  3. The use of the content referred to in paragraph 1, to an extent exceeding fair use, requires the Foundation’s prior consent, expressed in writing or in a documented form (e.g. by email).
  4. The use of the Website’s content within the scope of fair use, including the right to quote, is governed by the provisions of the Act on Copyright and Related Rights, provided that the source and author are cited.
  5. Requests for permission to use the materials should be sent to fundacja.awk@gmail.com.

§ 7. Liability

  1. The Foundation endeavours to ensure that the content on the Website is accurate and up to date. Historical and genealogical materials are compilations and may be supplemented or corrected as research progresses.

  3. The information published on the Website does not constitute an offer within the meaning of the Civil Code.

§ 8. Complaints and reporting of irregularities

  1. Comments regarding the operation of the Website and reports concerning its content — including requests to correct historical data or to remove material that infringes someone’s rights — should be sent to the email address fundacja.awk@gmail.com or via the contact form.
  2. The report should include a description of the matter and the reporter’s contact details.
  3. The Foundation will consider reports without undue delay and respond to the reporter’s email address. Requests concerning personal data will be considered within the timeframes specified in the privacy policy (point 6).

§ 9. Amendments to the Terms and Conditions

  1. The Foundation may amend these Terms and Conditions, in particular in the event of changes to legislation or the scope of the Website’s operations.
  2. The amended Terms and Conditions shall take effect from the date of publication on the Website and shall apply to messages sent after that date. Previous versions of the Terms and Conditions remain available at fawk.pl/regulamin/archiwum.
